For Booking and Use of Sports Facilities

This Agreement is an official public offer by the Operator, LLC “SOKKER.UA”, to conclude an Agreement for the booking and use of sports facilities presented on the website https://mistosportu.com.ua/.

This Agreement is general in nature, meaning that its terms are the same for all users regardless of their status (individual, legal entity, or individual entrepreneur) without giving preference to any particular party.

By making a booking through the website form or by any other means, the User fully accepts the terms of this Agreement. The Agreement is considered concluded from the moment the booking is confirmed and an electronic confirmation is received from the Operator.

1. Definitions

1.1. Public Offer (hereinafter “Offer”) – the public proposal by the Operator, addressed to an indefinite circle of persons, to conclude an Agreement for the booking and use of sports facilities (hereinafter “Agreement”) on the terms set forth in this document.

1.2. Sports Facility or Service – the facility chosen by the User on the “Misto Sportu” website for organizing activities, training sessions, competitions, or other events.

1.3. “Misto Sportu” Website – the online resource located at https://mistosportu.com.ua/, created for concluding booking agreements and providing services for the use of sports facilities.

1.4. User – a legally competent individual (over 18 years of age) who receives information about sports facilities, makes a booking for the use of services, or a legal entity/individual entrepreneur.

1.5. Operator – the legal entity LLC “SOKKER.UA”, which organizes and provides booking and usage services for sports facilities within the “Misto Sportu” system, acting in accordance with the applicable legislation of Ukraine. The Operator’s details are provided in Section 11, “Address and Details of the Operator.”

2. Subject of the Agreement

2.1. The Operator undertakes to provide the User with booking and use services for the selected sports facility, and the User undertakes to pay the booking fee and comply with the rules of use.

2.2. The date of conclusion of the Agreement (acceptance of the Offer) and the moment of full acceptance of its terms shall be deemed the moment of filling out and confirming the booking form on the website, provided that an electronic confirmation from the Operator is received.

2.3. At the request of the parties, the Agreement may also be executed in written form.

3. Booking Procedure

3.1. The User shall independently make a booking through the designated form on the “Misto Sportu” website or by contacting the details provided in the “Contacts” section.

3.2. The Operator reserves the right to refuse a booking if the information provided by the User is incomplete or raises doubts about its accuracy.

3.3. When making a booking, the User is required to provide the following mandatory information:
   3.3.1. Surname and First Name;
   3.3.2. Contact phone number;
   3.3.3. Email address;
   3.3.4. Identification details (Tax Identification Number for legal entities or, if necessary, for individual entrepreneurs);
   3.3.5. Date, time, and duration of the booking;
   3.3.6. The selected sports facility and any additional requests (if applicable).

3.4. Information about the selected sports facility (name, location, booking fee) is published on the “Misto Sportu” website.

3.5. If necessary, the Operator may request additional information to confirm the booking. In the event that the required information is not provided by the User, the Operator shall not be held liable for any inconvenience.

3.6. Booking confirmation is provided by means of an electronic message sent to the User upon successful submission of the booking form.

3.7. The User is responsible for the accuracy of the information provided.

3.8. By making a booking, the User confirms that they have read and agree to the terms of this Offer, and consents to the processing, use, and transfer of their personal data for the performance of the Agreement, settlement of accounts, and receipt of confirmation documents.

4. Price and Payment of Services

4.1. The cost of the booking and usage services for the sports facilities is determined by the Operator and indicated on the “Misto Sportu” website.
   4.1.1. Prices are stated in hryvnias and may include value-added tax (VAT).

4.2. The cost of services may be unilaterally changed by the Operator depending on current tariffs and seasonal variations.
   4.2.1. However, the price paid for a previously confirmed booking cannot be unilaterally altered.

4.3. Payment for services is made by the methods specified in the “Payment” section on the website.

4.4. The obligation for payment is considered fulfilled upon receipt of funds in the Operator’s account.

4.5. Documentary confirmation of payment and booking is sent to the User via email.

5. Rights and Obligations of the Parties

5.1. The Operator undertakes to:
   5.1.1. Provide the booking and use services for the sports facility in accordance with the terms of the Agreement.
   5.1.2. Ensure the confidentiality of the information provided by the User, except as required by applicable law.

5.2. The Operator has the right to:
   5.2.1. Unilaterally amend the terms of the Agreement and the service tariffs by publishing updated information on the website. Such changes become effective upon publication.
   5.2.2. Refuse a booking if the information provided by the User is incomplete or inaccurate.

5.3. The User undertakes to:
   5.3.1. Familiarize themselves with the terms of the Agreement and the tariffs published on the website.
   5.3.2. Provide complete and accurate information when making a booking.
   5.3.3. Comply with the rules for using the selected sports facility.

6. Cancellation and Changes to Booking

6.1. The User has the right to cancel a booking provided that the Operator is notified at least 24 hours prior to the start of the booking (unless otherwise specified by special conditions).

6.2. In the event of cancellation, the conditions for refund are determined in accordance with the Operator’s policy published on the website.

6.3. Changes to the booked dates or terms of use may be made by agreement with the Operator.

7. Liability of the Parties

7.1. The Operator shall not be liable for any damages that may occur to the User or third parties due to non-compliance with the rules for using the sports facility, unless such damages are a direct result of a breach of the terms of this Agreement.

7.2. The parties are liable for failure or improper performance of their obligations in accordance with the applicable legislation of Ukraine and the provisions of this Agreement.

7.3. The parties shall be exempt from liability for partial or complete non-performance of obligations if it is due to force majeure circumstances (e.g., war, natural disasters, etc.).
   7.3.1. The party unable to perform its obligations must immediately notify the other party.

8. Confidentiality and Protection of Personal Data

8.1. By providing their personal data during registration or when making a booking on the website, the User gives their voluntary consent for its processing, use, and transfer in accordance with the Law of Ukraine “On Personal Data Protection” for an indefinite period.

8.2. The Operator undertakes not to disclose the received information, except as provided by law or as necessary for the performance of its obligations to the User.

8.3. The User is responsible for timely updating their personal data.
   8.3.1. The Operator shall not be liable for any consequences arising from inaccuracies or outdated information.

9. Other Terms

9.1. This Agreement is concluded within the territory of Ukraine and is governed by the current legislation of Ukraine.

9.2. Any disputes arising between the Operator and the User shall be resolved through negotiations.
   9.2.1. If an agreement cannot be reached, the dispute may be submitted to the courts under the local jurisdiction.

9.3. The Operator has the right to unilaterally amend this Agreement by publishing a new version on the website.
   9.3.1. The amendments become effective upon publication.
